Policy

1. Nature of This Agreement

The rights and obligations contained in this agreement govern your use of the vehicle and are not transferable. You acknowledge that the vehicle is owned by the Company, and any attempt to transfer, sublet, or rent the vehicle to another person is void.

The Company permits you to use the vehicle only under the terms and conditions outlined in this agreement.


2. Who May Drive the Vehicle

2.1 Authorised Drivers

The vehicle may only be driven by:

  • The named hirer; or
  • Any additional driver authorised in advance by the Company.

You must not allow any unauthorised person to drive the vehicle. If an unauthorised driver is found operating the vehicle:

  • The security deposit may be forfeited.
  • The vehicle may be recovered immediately.
  • Any hire charges paid will be non-refundable.

2.2 Driver Requirements

Drivers must:

  • Meet the minimum age requirements.
  • Hold a valid driving licence.
  • Not be under the influence of alcohol, drugs, medication, or any substance affecting their ability to drive safely.
  • Not be excessively tired or otherwise impaired.

3. Pick-Up, Delivery & Return

3.1 Vehicle Condition

The Company will provide the vehicle in good operating condition with all necessary documents, parts, and accessories.

Dash Cameras: Dash camera footage may be used to determine fault in the event of an accident. If dash cameras are tampered with or footage cannot be recovered, the hirer may lose the right to the security deposit and may be liable for damages.

3.2 Return Requirements

You agree to return the vehicle:

  • In the same condition received (fair wear and tear excepted).
  • With all supplied documents, accessories, and equipment.
  • At the agreed location, date, and time.

3.3 Vehicle Inspection

A joint inspection will be conducted at collection and return. Any new damage, loss, or defects occurring during the hire period are the responsibility of the hirer.

3.4 Late Returns

Hire periods are calculated in 24-hour blocks.

Failure to return the vehicle on time may result in:

  • Additional daily hire charges.
  • Extra option charges.
  • Deductions from the security deposit.

3.5 Cleaning Charges

If the vehicle requires cleaning beyond normal use standards, additional cleaning charges may apply.


4. Responsibility for Loss or Damage

4.1 Hirer’s Liability

You are responsible for all reasonable losses arising from:

  • Damage to the vehicle.
  • Theft of the vehicle.
  • Loss of parts or accessories.

Charges may include:

  • Repair costs.
  • Vehicle depreciation.
  • Loss of income.
  • Recovery and storage fees.
  • Administrative expenses.

4.2 Tyres

The hirer is responsible for:

  • Excessive tyre wear.
  • Tyre punctures occurring during hire.
  • Ensuring replacement tyres match the original brand and specification.

4.3 Exceptions

You will not be liable where loss or damage results directly from the Company’s negligence or breach of contract.


5. Prohibited Use of the Vehicle

The vehicle must be used responsibly at all times.

You Must Not Use the Vehicle:

  • To carry passengers for payment.
  • To carry cargo for payment (unless authorised).
  • To tow or push another vehicle without permission.
  • Off-road or on unsuitable roads.
  • When overloaded.
  • To transport hazardous or damaging substances.
  • For racing, rallies, testing, or competitions.
  • For illegal activities.
  • For driver training.
  • For sub-hire or re-rental.
  • In restricted areas such as airport runways or service roads.
  • In breach of any traffic laws or driver eligibility requirements.

Vehicle Care

You must:

  • Keep the vehicle secure when unattended.
  • Use all supplied security devices.
  • Ensure seatbelts and child restraints are used appropriately.
  • Check fluids and tyre pressures after 500 miles.
  • Obtain Company approval before arranging repairs.

International Travel

The vehicle must not be taken outside mainland United Kingdom (excluding Northern Ireland) without prior written approval.

Driving Time Restrictions

Certain vehicles, including supercars, may not be driven during late-night or early-morning hours unless authorised in writing.

Breaches may result in:

  • Additional charges.
  • Termination of hire.
  • Forfeiture of the security deposit.

6. Refuelling & Fines

6.1 Fuel Policy

The vehicle must be returned with the same fuel level supplied at collection.

Additional fuel left in the vehicle will not be refunded.

6.2 Congestion Charges

The hirer is responsible for:

  • London Congestion Charges.
  • Birmingham Clean Air Zone charges.
  • Any similar city or town road-use charges.

6.3 Traffic Offences

The hirer is responsible for:

  • Parking fines.
  • Speeding tickets.
  • Congestion charges.
  • Any associated administration fees.

Any notices received after the hire period may be forwarded to the hirer.


7. Additional Charges

The following charges may be deducted from the security deposit.

7.1 Penalty Administration Fee

£35 per fine or ticket

7.2 Excess Mileage

Additional mileage charges apply above the agreed allowance.

7.3 Late Return Charges

  • £100 for every 30 minutes late.
  • Maximum 3-hour grace period.
  • More than 3 hours late may result in full deposit forfeiture.
  • Additional daily hire charges may also apply.

7.4 Accident & Damage Charges

  • Accident excess applies regardless of fault.
  • If fully at fault, liability may extend to the vehicle’s full market value.
  • Third-party claims carry a compulsory excess of £5,000.

7.5 Fuel Charges

7.6 Vehicle Not Returned

  • Loss of security deposit.
  • Recovery costs charged to the hirer.

7.7 Breakdown Procedure

The hirer must:

  • Contact the Company immediately.
  • Wait for recovery assistance.

Where possible, a replacement vehicle may be provided or unused hire days refunded.

7.8 Excessive Speeding

  • £150 charge per excessive speeding warning.
  • On the 4th warning, the full deposit may be forfeited.
  • Vehicle reactivation fee: £150

7.9 Careless or Dangerous Driving

The Company reserves the right to:

  • Terminate the hire immediately.
  • Recover the vehicle.
  • Retain the full security deposit.

7.10 Vehicle Cleaning

If the vehicle is returned significantly dirtier than collected:

  • £20 cleaning charge

7.11 Smoking

Smoking is strictly prohibited.

  • £20 charge

7.12 Pets

All vehicles operate under a No Pets Policy.

  • £50 charge

8. Personal Data

By entering into this agreement, you consent to the storage and processing of your personal data for purposes including:

  • Credit control.
  • Asset protection.
  • Statistical analysis.
  • Recovery of debts or losses.

Where necessary, your information may be shared with third parties assisting in recovery or enforcement activities.


9. Interpretation

If any part of this agreement is found to be invalid, illegal, or unenforceable, the remainder of the agreement shall remain fully valid and enforceable.


10. Applicable Law

The Company aims to resolve disputes amicably wherever possible.

Where legal proceedings are required:

  • The laws of England and Wales shall apply.
  • You agree to the non-exclusive jurisdiction of the English Courts.

Acceptance of Terms

By accepting these Terms & Conditions, you confirm that:

  • You have read and understood this agreement.
  • You agree to comply with all terms.
  • The security deposit may be used to recover any outstanding amounts owed.
  • Any balance exceeding the deposit remains your responsibility.
  • You will be liable for legal costs incurred in recovering unpaid sums.
  • You accept responsibility for any new damage not recorded on the vehicle condition report.
  • The Company may retain the security deposit for up to 14 days where further inspection is required.

THIS AGREEMENT REMAINS VALID UNTIL THE VEHICLE HAS BEEN RETURNED TO THE COMPANY.
